These Terms explain the rules for using Fluenta. Please read them carefully before using the Services.

1. About these Terms

These Terms of Service (the “Terms”) govern your access to and use of Fluenta’s website at fluenta.so, the Fluenta mobile application, and related products and services (together, the “Services”).

By downloading, installing, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least 13 years old, or the minimum age required to use the Services in your location, whichever is higher. If you are not an adult where you live, you may use the Services only with the permission and supervision of a parent or legal guardian.

Some features require an account. You agree to provide accurate, current information and keep your account details up to date. You are responsible for protecting your login information and for activity that occurs through your account. Tell us promptly at help@fluenta.so if you believe your account has been accessed without permission.

3. Using Fluenta

Subject to these Terms, Fluenta gives you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Services for language learning and other lawful, non-commercial purposes for which they are made available.

You may use Fluenta to practice, explore, and improve your language skills. You remain responsible for your decisions and for anything you submit, record, or share through the Services.

4. Fair use

Fluenta is intended for ordinary individual language practice. Fair use means using the Services in a way that is reasonable for a person learning a language and that does not degrade the experience for other users or place an unreasonable burden on our systems.

We may apply reasonable limits to usage, including limits on request volume, conversation length, storage, or access to particular features. We may adjust these limits as the Services change. We may contact you or limit access when your use is unusually high, abusive, automated, or inconsistent with the intended purpose of Fluenta.

5. Prohibited conduct

You may not use the Services to:

  • Break the law, violate another person’s rights, or help someone else do so.
  • Harass, threaten, intimidate, exploit, discriminate against, or target another person or group.
  • Generate, upload, record, or share sexually exploitative content, content involving minors in a sexual context, credible threats of violence, or content that encourages self-harm.
  • Impersonate another person, misrepresent your identity or age, or provide false information to gain access.
  • Upload or share personal, confidential, or copyrighted information that you do not have permission to use.
  • Circumvent safety features, access controls, usage limits, or account restrictions, including safeguards around AI features.
  • Scrape, harvest, copy, or extract data from the Services, or use bots, scripts, crawlers, or other automated means without our written permission.
  • Introduce malware, interfere with the Services, or attempt unauthorized access to our systems or another user’s account.
  • Use Fluenta or its outputs to build, train, or improve a competing language-learning or artificial intelligence product.

6. Respectful use and safety

Fluenta is designed for language learning, not for professional advice or emergency support. Do not rely on the Services for medical, legal, financial, immigration, academic, employment, or other high-stakes decisions. If you or someone else may be in immediate danger, contact local emergency services or a qualified professional instead of using Fluenta.

7. Your content

You retain the rights you have in the text, audio, feedback, and other content you provide to Fluenta (“User Content”). You are responsible for making sure you have the rights and permissions needed to provide that content.

You give Fluenta a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transcribe, translate, and display User Content as reasonably necessary to operate, secure, personalize, and improve the Services, and to comply with law. This license ends when the content is deleted, except where retention is required for legal, security, or technical reasons.

You must not submit content that is unlawful, harmful, infringing, or that violates another person’s privacy. We may remove content that violates these Terms or creates risk for Fluenta or its users.

8. Fluenta’s intellectual property

The Services and their software, design, text, graphics, audio, features, trademarks, and other materials are owned by or licensed to Fluenta and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, Fluenta does not grant you ownership of or any license to its intellectual property. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services unless applicable law gives you that right or we give you written permission.

9. AI-generated content

Fluenta uses artificial intelligence to generate conversation replies, translations, corrections, suggestions, and other content. These outputs may be inaccurate, incomplete, outdated, biased, or inappropriate. They may also vary between users and from one request to the next.

You should review outputs before relying on them. Fluenta does not guarantee that any output is correct or suitable for your particular purpose, and you are responsible for how you use it. Fluenta may change, restrict, or discontinue AI features at any time.

10. Subscriptions and purchases

Some Fluenta features may require a paid subscription. Prices, billing periods, trial terms, renewal details, and available features will be shown before you subscribe. Purchases made through a mobile app are processed by the relevant app store or payment provider, and subscription access may be managed through that provider.

Unless the purchase terms say otherwise, subscriptions renew automatically at the end of each billing period until cancelled. You can cancel through the provider used for the purchase. Cancelling stops future renewals but generally does not refund the current period. For purchases made through Apple’s App Store or Google Play, refund requests are generally handled by the applicable app store under its own rules and applicable law. Fluenta does not independently process those app-store refunds.

We may change prices or paid features with reasonable notice where required. Taxes, fees, and charges imposed by your payment provider may apply.

11. Suspension and termination

You may stop using Fluenta or delete your account from the Delete account option in Settings. You may also ask us to delete your account at any time by contacting help@fluenta.so. Deleting the app from your device does not necessarily cancel a subscription; cancel it through the provider where you purchased it.

We may suspend or terminate your access, with or without notice when reasonably necessary, if you violate these Terms, misuse the Services, create a security or legal risk, fail to pay applicable fees, or if we are required to do so by law. We may also suspend access while investigating suspected abuse or protecting the Service.

We will consider the circumstances and severity of an issue when deciding what action to take. Where appropriate, we may warn you, limit a feature, or give you an opportunity to correct the problem before a longer suspension or termination. Serious or repeated abuse may result in an immediate ban.

If you believe your account was suspended or terminated in error, contact help@fluenta.so with the account email and relevant context. We may not restore access when doing so would create a security, legal, or safety risk.

12. Availability and changes

We work to keep Fluenta useful and available, but the Services may be unavailable, delayed, or changed from time to time because of maintenance, updates, outages, third-party services, or circumstances outside our reasonable control. We may modify, pause, or discontinue part or all of the Services. We will provide notice when required by applicable law.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind. We do not promise that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that they will meet every expectation or learning goal. Nothing in these Terms excludes a warranty or right that cannot be excluded under applicable law.

14. Limitation of liability

To the fullest extent permitted by law, Fluenta and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, revenue, goodwill, or opportunities arising from or related to your use of the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid us for the Services during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. This section does not limit liability that cannot be limited under applicable law.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Fluenta and its affiliates, officers, employees, contractors, and service providers from claims, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your User Content, your use of the Services, your violation of these Terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from Fluenta’s own unlawful conduct or liability that cannot be shifted under applicable law.

16. Third-party services and app stores

The Services may link to or depend on third-party websites, platforms, content, or services. Those third parties operate under their own terms and privacy policies, and Fluenta is not responsible for their acts, omissions, availability, or content. If you download Fluenta through an app store, your use may also be subject to that store’s terms. The app store is not responsible for providing support or handling claims about Fluenta, except as required by its own terms or applicable law.

17. Beta and experimental features

We may make beta, preview, experimental, or early-access features available from time to time. These features may be incomplete, contain errors, change without notice, or be discontinued. Unless applicable law requires otherwise, beta features are provided as available and without additional warranties or support commitments. Feedback you provide about them may be used by Fluenta to improve the Services.

18. Effect of termination

When your access ends, the license to use the Services ends and you must stop using them. Termination does not affect rights or obligations that arose before termination, including payment obligations and the provisions concerning User Content, intellectual property, disclaimers, liability, indemnification, and dispute-related rights. We may retain information where required or permitted by our Privacy Policy or applicable law.

19. General terms

These Terms and the Privacy Policy are the entire agreement between you and Fluenta about the Services and replace prior agreements about the same subject. If a provision is found invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.

A delay or failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign or transfer these Terms or your account without our written consent. Fluenta may assign these Terms in connection with a merger, acquisition, reorganization, or transfer of the Services. We are not responsible for delay or failure caused by events beyond our reasonable control.

20. Applicable law and disputes

These Terms are governed by the laws of England and Wales. Subject to any mandatory rights you have under the laws of the country where you live, the courts of England and Wales will have non-exclusive jurisdiction over disputes relating to these Terms or the Services. Nothing in this section limits consumer protections, rights to bring a claim in your local courts, or other rights that cannot be waived under the laws that apply to you.

21. Changes to these Terms

We may update these Terms as Fluenta, our practices, or applicable laws change. When we do, we will update the date at the top of this page and provide additional notice when required. Your continued use of the Services after updated Terms take effect means you accept them. If you do not agree, stop using the Services.
